Fodder Case is posted for 30th September, when the judgement will be out deciding on the fate of the accused 45 persons, which importantly includes RJD Chief Lalu Prasad Yadhav.
The Justice Pravas Kumar Singh’s court, after hearing the arguments of the Defence counsel Surendra Singh has reserved the judgement on the case of fraudulent withdrawal of Rs 37.7 crore from the Chaibasa treasury, which allegedly happened in 1990s.
Lalu Prasad’s counsel argues that the prosecution is not valid since the then State Governor had approved the prosecution order against Lalu Prasad without obtaining clearance from the Central Cabinet, which the CBI rejects saying it was not necessary for the Governor of the State to take permission from the Cabinet.
Out of 53 Fodder Cases, 44 have already received judgements in the past years.
Lalu’s advocate also claims that his client did not know about the scam till 1996,and alsoinforms the court that the former Chief minister of Bihar State was the one who had issued directions to lodgean FIR in this case to take action against the guilty the very moment he learnt about it on January 21 that year, after going through the preliminary report placed by the then Finance Commissioner V S Dubey.
In this case of fraudulent withdrawal of huge sums from different treasuries of the then undivided Bihar, there were 41 FIRs lodged against whoever was guilty and this has been put up as a strong defence on Lalu Prasad’s non-involvement in this case.
